This public contract (hereafter referred to as contract ) is formulated
with a view to improving service standard, strengthening management, safeguarding
corporation property and legitimate and interests of proprieties and residents.
Chapter 1 General provisions
Article 1 ZhuHai Villa Village Real Estate Managing Company (hereafter
referred to as managing company) is a company keeping separate account, servicing the
proprietores, and managing the real estate. It takes charge of the houses, public
facilities and orders. All proprietors, residents and concerned people should support
their work.
Chapter2 The obligations of managing company
Article 3 Service level: Imply service with high-efficient management
, welcome the visit of proprietors, residents and clients, solicit their opinions regularly
and meditate for them.
Article 4 Responsible for the management and operation of the real
estate, and maintenance of public facilities.
Article 5 For better service and management, draft, cancel or amend the
regulation as per the rules and rational opinion.
Article 6 Arrange maintenance regularly for the perfection of necessary
facilities.
Inspect and get rid of the accumulated rain and dirty water in public
places, and maintain the pipeline.
Brush the public fence and enclosing wall in certain period as
stipulated. Check and repair the facilities of water and electricity and share the expense
among the residents.
Article 7 Maintain the lighting and firefight equipment of the public
places, and make sure they work efficiently.
Article 8 Keep the clean of the village and carry out a routine check.
Article 9 Rules to the vehicles
No permission to enter until washed down Forbid to study or practice
driving in village, or wash the vehicles in public places Drivers should drive obeying the
marks. No tooting. The appropriate speed is 30 km per hour. Trunks over 1.75 ton
deadweight are forbidden to enter, except that the managing company allows them.
The vehicles of the proprieties and residents should show their entry
license of Golf Villa Village. Other vehicles should go through the entry formalities, and
abide by the rules.
Article 10 Response for the maintenance and management of the afforest.
In charge of the afforest to keep the villa in perfect harmony
The plants of Private Park should not damage the monitor system against
burglars and enclose circuit television in the fence and enclosed wall. Otherwise, the
managing company has right to get rid of them or move them.
Article 11 Response for the security insurance beforehand coordinating
with local police station.
Article 12 Collect concerned fee from the proprietors, residents and
other payees. Delay of payment should pay 1 percent overdue fine of the charges. Delay for
two months should be resolved by law.
Article 13 Charge managing fee and list an item separately for special
use. The balance of charge of each year should be announced publicly, and supervised by
upper authority and payees.
Article 14 correct and resolve the behaviors against the regulations.
Chapter 3 Rights and obligations of proprietors,
residents, and users
Article 15 Enjoy rights of possession and use according to law.
Article 16 Enjoy right of using public places and facilities of the
village.
Article 17 Enjoy right of voting, proposing, and counseling to the
managing system.
Article 18 enjoy right of supervising and appealing to the managing
company and its staff.
Article 19 Pay charges to managing company regularly.
Article 20 Management of the private park
As an important part of the village, the proprietors should pay
attention to the afforest of their park. If they entrusted them to the managing company
, they should pay for the service.
The proprietors may take care of their park themselves, so long as they comply with the
standard of keeping the harmony of the village. Otherwise, the managing company has right
to trim their plants and charge twice of the service fee.
Article 21 Obey the following rules when use the houses
No changing of the structure, use, and appearance
No permitting to chisel, dismantle, and rebuild the wall indoors and
outdoors, roof beam, balcony, terrace, and corridor without technical license.
No permitting to put combustibles and explosive substance in houses, or
firing outdoors. Picnic in the park is allowed under the precise of no heavy smoke.
No permitting to engage in behaviors against the law damaging the
public interests and others legal rights.
No occupying the public facilities and places privately or disturbing
others' rights.
Article 22 the proprietors and residents have rights to repair,
decorate and rebuild the houses in the limit permitted, and should apply to the managing
company in advance by submitting the working draw, the items of decoration, its content,
repair time, unit in charge of the construction, number of the workers, the responsible
person, and so on. Get the decoration license and hand in cash deposit of 5000yuan Rmb
beforehand. The air-conditioners should be equipped in the position planned by the
managing company. No permitting to break down the walls and damage the structure of the
houses. The rubbish and materials should not pile up in public places. All the sundry and
rubbish should be cleared in time. It is available to pay for the managing company to
clear. The deposit will be returned if there is not case against the rules.
Article 23 the guarantee period are calculated from the completed
houses have been delivered to the proprietors by the developer, and were guaranteed by the
managing company.
The contend and period of guarantee should accord with terms of Quality
Guarantee of Golf Villa Village, and Direction of Golf Villa Village. But damages due to
the proprietors and residents are not included in the guarantee. In normal situation, the
proprietors and residents should response for the repair after the guarantee period.
Article 24 Inform the family members and visiting relatives of the
rules, and take joint liability for their behaviors.
Article 25 Abide by the rules of household register and public
security.
Article 26 Make no noise during the resting time.(12: 00 am to
2: 00pm,11: 00pm to 7: 00 am)
Article 27 Rubbish should be put into plastics, and put them at fixed
place. The managing company will cope with them afterweard.
Article 28 Following behaviors are forbidden
split,Raise poultry, cattle, and wolfhound
Connect wire or dig road and grassland without permission.
Set up buildings against the rules
Damage the water and electric installation, plants and public
facilities.
The vehicle run over the grassland
Hang banner or commercial marks in park or outdoors
Post or hang advertisement board without permission, or write, script,
draw on public facilities.
Chapter 4 charges for management
Article 29 charges of service by managing company should be shared
among the proprietors. The whole fee is used for routine service and the maintenance of
the facilities of security insurance, safeguard, firefight, afforest and so on.
Article 30 Standard of managing fee: 4.8 Yuan RMB every month per sm.
Electric fee: 0.83 Yuan per kwh, water fee: 1.02 Yuan/ton. Proprietors and residents will
be notified if there is any change later.
Article 31 The charges begin from the day of the signing of the
Delivering confirmation or the next day delivering of the keys, no matter the houses were
used or not, it is necessary to pay for the managing charges.
Article 32 Charging time: in 10th or 15th of the next month in forms of
cash, check, or bank transferance.
Article 33 The proprietors should go through the name changing
procedures at the of ZhanHai Real Estate managing center and at our managing company.
Before the notifying of the company, the former proprietors should pay the charge of
management.
Chapter 5 liability
of breach of contract
Article 34 the real estate managing company has rights to forbid the
behaviors against the contract and rules and ask for compensation.
Article 35 To the employees of managing company, the penalty would be
heavier if they break the contract. The employees should compensate for the damage caused
by their malfeasance and neglect.
Chapter 6
supplementary condition
Article 36 The contract is to be amended or be supplemented as per
concerned rules and policies. It can also be amended with the poll of two third of the
proprietors and residents under the precise of obeying the laws.
Article 37 The contract comes into effect after the signing and sealing
of both parts. The contract is in duplicate, the managing company and the proprietor (the
resident) each keeps one.
